DescriptionWe had a great day at Fairyhouse yesterday and hopefully we can keep up the good work at Naas today. Mozoltov (Bryan Cooper) runs in the Grade 2 Novice Chase over 2m 4f. The race conditions really suit and his third in the Arkle at Leopardstown last time should be good enough here. This longer trip won’t be a problem. We have two in the Grade 2 Novice Hurdle over 2 miles. City Slicker (Tony McCoy) won over 2m 4f at Punchestown last month and the drop back in trip here should be okay. He is an improving type but he is a difficult ride and going left-handed is not his favoured direction. Vicky De L’Oasis (Ruby) is well suited by the race conditions and, if she handles the ground, she must have every chance. Twinlight (Ruby) goes for the Grade 2 Chase. He didn’t travel well when disappointing at Kempton last time but, if we put a line through that run, he looks the one to beat here. He will like the testing ground conditions. Killultagh Vic (Patrick) runs in the winners’ bumper. He won over 2m 3f here last month and we don’t think the drop back in trip today will be a problem. He will handle the ground and we are expecting a good run in what looks like a hot contest. Note: We have added a new video to the Cheltenham Festival page.

Woodlands Park 100 Club Nas Na Riogh Novice Chase (Grade 2) 2m4f 5yo+
MOZOLTOV first, the rest nowhere.
The three-runner Nas Na Riogh produced a one-runner contest as the Willie Mullins-trained 2-13 favourite came home in splendid isolation, around a fence clear, from Folsom Blue and Summer Star.
Even so, Bryan Cooper on the winner had to endure poor jumps from his mount at the first fence and again at the last, although only a fall would have changed the outcome

 Have you noticed that David doesn't like noise, I think music comes into that category as well. He can't concentrate when there is noise, it distracts  him. If David was a racehorse he would be fitted with blinkers to keep him focused.
"DEAR Mr Hill, I understand Ralph Topping, who, let's face it, is getting on a bit, can't wait to pack the job in (by the end of 2015 anyway).. And why not? Forty years with William Hill must be enough to drive anyone barmy (is that what's happened?).
 
"Anyway, to get to the point, I'd like to throw my hat into the ring to be William Hill's next chief executive. I expect you already know but, just to remind you, it is unlawful to reject a candidate for a job on the basis of age, even if that person is 65, as I happen to be. You have been warned.
 
"Experience (as anyone my age is inclined to emphasise) is so important and mine goes back further even than Topping's. Evidently he made his debut at a Hills shop in Scotland. In about 1970, while I made mine at a shop in England about four years earlier. He seems to have made money while I was loosing it and I do hope Hills paid better than Ladbrokes used to when I was a boardman in a shop of theirs at Bradford.
 
"But I digress, As you would expect, I have followed William Hill's recent history with interest. To give Topping his due (well, we can, now he's going) he has done Hills proud and set them fair for further progress under new leader (me) .
 
"Stability is essential and, although Topping's total remuneration in 2012 was more than £1.9 million I don't understand why there was such a fuss over the firm's decision to give his chief executive another £1.2m if he agreed not to disappear before the end of 2013.
 
"I'm all for retention payments and think double the incumbent's basic salary is about right. On that basis, I will be prepared to stay for at least a couple of years, although the basic salary, which was £650,000 in 2012, might need topping up (get it)?
"There will, of course, be changes. I'll be making an early call at that shop opposite Victoria Coach Station. The last time I visited, the toilets were terrible).
 
"Betting shops have come a long way since the dark days (the cigarette smoke was awful ) when there were no televisions and no cups of tea and not much in the way of seats, either - but let's face it, not every change has been for the better.
 
 
So I'll kick off by cutting the Gordian knot of gaming machines. Forget the great debate about problem gambling and let's just consider the horrible noises they make.
 
"We'll turn the sound off and give customers the option of either playing for no more than 15 minutes a day or going to the 'Swap Shop' in the corner and exchanging as many £10 notes as they like for £9.70 each. It will save everyone a lot of time and customers a lot of money, which they can spend on horse and dog racing, and other sports. Not on virtual sports, though, they'll be given the boot.
 
"There are lots of television screens but, nowadays, bookmakers are in such a rush to draw customers' attention to the betting opportunity the recent racing results don't seem to be given the prominence they deserve. We'll sort that out. There will be free Eccles cakes and almond croissants and those small, sticky-all-the-year-round Easter eggs with every yankie.
 
"Granted, profits might take a bit of a hammering. but what we (I already feel part of the team) lose on the roulette wheels we will  make up on the mobiles. They seem to be going swimmingly and I'm looking forward to visiting our new 'centre of excellence' in Shoreditch; but only once. I'm not sure Scruttion Street is quite my cup of tea and I expect the boffins can get on very well without their chief executive poking his head around the laboratory door.
 
"No, I'll be concentrating more on the international-or global,  as I'll insist we call it-side of things. As well as visiting our  operation in Las Vagus, I thought we might explore possibilities in the Seychelles. If it's good enough for the Beckhams, it's good enough for William Hill,  chief executive branch!
 
 
"Talking of offshore, it's only fair we pay the levy on the horseracing bets we take via Gibraltar. Should we make a voluntary payment or move the whole shebang back home? After all, once point of consumption tax arrives, what's there apart from a big rock and no levy?

Facts


This case was reported in the last edition of Masons Computer Law Reports ([2001] Masons CLR 79).  In the High Court Laddie J. held that William Hill had infringed the database rights of the British Horseracing Board (“BHB”), in that William Hill’s use of the information contained in BHB’s annual fixture database for its website business was an extraction or re-utilisation of a substantial part of the database, contrary to Article 7(1) of the directive on the legal protection of databases (“the Directive”).  Alternatively, William Hill’s actions were held to be infringing by virtue of its repeated and systematic extraction or re-utilisation of insubstantial parts of the contents of the database, contrary to Article 7(5) of the Directive.  BHB was granted an injunction restraining William Hill from using the content of the database for its internet business.

William Hill appealed against the decision.  The appeal was on the basis, amongst others, that (1) the Court had not considered the fact that William Hill only used the information contained within the database, it did not copy or use the form of the database (i.e. the “database-ness”) in any way; and, (2) the interpretation of the database right by the High Court gave an excessively wide protection to databases.  William Hill made specific reference to other EU jurisdictions (Sweden and the Netherlands) where a narrower approach to the Directive had been adopted.

There were fraudulent British Whip Rules placed within the British Rules of  Horseracing in
October  2011.  After two bloodhorse illiterate people who couldn't ride were put on by BHA
to Review the British Whip Rules. These scam rules have remained in place ever since. The bloodhorse illiterate British Rules of Horseracing Whip abuse is evil.
 
There is  no legal  British or  Global  legal justice whatsoever for all those who work the
horses, at the dangerous sharp end of global horseracing every day with the horses every day
 

The Legal set up within horseracing  does not belong in the Equus Zone The Legal set up
 knows very little about the Equus Zone and therefore is unqualified to give any fair and reasonable judgement.

George Osborne and David Cameron do not act very fast as neither do any of their County Council Social Services. It is estimated that it takes them 2 months to do anything at all. The horseracing government take more like 2 years if at all.

DATABASE PROTECTION NARROWED: BRITISH HORSERACING BOARD v WILLIAM HILL

"The Database Right, which was thought to provide wide-ranging protection for databases far beyond that afforded by standard copyright, has been narrowed. On 9 November 2004, the European Court of Justice finally ruled in the case of British Horseracing Board v William Hill by giving answers to some key questions regarding interpretation of the Database Right, which was created by an EU directive and implemented in the UK by the Database Regulations 1997. The ECJ ruled in William Hill's favour by finding no infringement of BHB's Database Right.

"The case involved the accessing of data from BHB's database of pre-race information by William Hill bookmakers (via an intermediary subscription service), which was then displayed on the William Hill website. Given the immense amount of information in the original database, it was accepted by both sides that William Hill had only displayed a small proportion of the total amount.

"During the second stage of the case in 2001, several key questions were put to the ECJ by the UK Court of Appeal including:

 
The Database Right Copyright does not belong to William Hill, as neither does it belong to the political and horseracing government's BHB or now to the BHA.

The Database Rights to include Picture Rights belong to the true Equus Zone to all those who work at the dangerous sharp end of horseracing every day without which there would be no horseracing. All those who belong within the true Equus Zone to include the horses as stated on every racecard every day.

 
The British Legal Justice System is Bloodhorse Illiterate not fit to tackle the likes of this every single day.


The British Political and Horseracing  governments are  Bloodhorse Illiterate.  Not fit to tackle the likes of this every single day. What they have been and are at present  guilty of doing, stands only to muddle, confuse and severely unjustly punish the wrong people to include the horses.
